These Terms & Conditions govern your use of the Acacia Tours website and your booking of our travel experiences, tours, and related services. By making a reservation with Acacia Tours, you acknowledge that you have read, understood, and agreed to these terms on behalf of yourself and all travelers listed in your booking.

No variation to these Terms & Conditions shall be effective unless made in writing by and with the authority of Acacia Tours.

By using acaciatours.pt, you agree to be legally bound by these terms, which take effect immediately.

If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use acaciatours.pt.

1. Use of Our Website

By accessing and using https://toursbyacacia.com, you agree to:

  • Use the site for lawful, personal, non-commercial use only.
  • Refrain from copying, modifying, or distributing any part of the site content without permission.
  • Accept that content, itineraries, and prices are subject to change without prior notice.

You may not use this site to make speculative, false, or fraudulent bookings, or use robots or other automated means to access the site, unless explicitly authorized by Acacia Tours.

2. Tour Bookings & Payment Policies

2.1 Reservation Process

Reservations can be made directly via our website, email, or through approved partners. A booking is only confirmed once Acacia Tours issues written confirmation and payment has been made.

2.2 Deposit and Final Payment

  • Deposit: A 25% deposit is required to secure your booking; When a booking includes accommodation, full payment for the hotel portion may be required at the time of booking, depending on the property’s terms. In such cases, Acacia Tours will request full payment upfront or a higher deposit to cover the non-refundable hotel charges. These conditions will be clearly communicated prior to confirmation. Hotel bookings are subject to the cancellation and refund policies of the hotel, which may be stricter than Acacia Tours’ standard terms.

  • Final Balance: The remaining balance is due 30 days before the tour date.

  • Short Notice Bookings: For bookings made within 30 days of the tour date, full payment is required at the time of booking.

2.3 Accepted Payment Methods

We accept payments via bank transfer (preferred), credit or debit card (subject to processing fees), and online payment platforms such as Wise, Stripe, or PayPal. Failure to pay on time may result in the cancellation of your booking.

3. Cancellation, Refunds & Modifications

3.1 Cancellation by the Client

If you choose to cancel your booking, you may be eligible for a refund depending on the timing of your cancellation. Cancellations made more than 30 days before the tour date are eligible for a full refund, minus any processing fees and non-refundable costs already paid to third-party providers (e.g. hotels, tickets, or transport). Cancellations made between 7 and 13 days before the tour date are eligible for a 50% refund. No refunds will be issued for cancellations made less than 7 days before the tour date. All refunds will be processed to the original payment method and may take up to 10 business days.

3.2 Modifications by the Client

Requests for changes must be made in writing:

  • At least 72 hours in advance for day tours

  • At least 7 days in advance for multi-day tours

All changes are subject to availability and may incur additional costs.

3.3 Cancellation or Modification by Acacia Tours

In rare cases, due to weather, safety, or logistical issues, Acacia Tours may cancel or modify a tour. In such cases, we will offer:

  • A full refund

  • An alternative date

  • A comparable replacement experience

3.4 Non-Refundable Entrance Tickets

Entrance tickets to attractions are subject to availability and will only be purchased after the deposit is received. All ticket sales are final and non-refundable, regardless of changes or cancellations.

4. Pricing & Inclusions

Prices listed on acaciatours.pt are per couple unless stated otherwise. Prices are based on local tariffs at the time of quoting and may change without notice until a booking is confirmed. All prices are in Euros (€) and include VAT at the applicable rate. Our prices include services specifically listed on the itinerary or product description page.

Unless otherwise stated, prices do not include:

  • Meals or beverages not explicitly mentioned in the tour description

  • Entrance fees not mentioned as included

  • Personal expenses

  • Passport/visa fees or travel insurance

  • Gratuities for guides or drivers

Prices are subject to change until the booking is confirmed.

5. Travel Documents & Responsibilities

It is the client’s responsibility to:

  • Ensure all travelers have valid passports, visas, and any required entry documents

  • Comply with local health regulations

  • Arrive at the designated meeting point on time

  • Inform Acacia Tours of any health conditions, allergies, or mobility restrictions. Failure to provide accurate information may affect your participation and result in denied service without refund.

It is the traveler’s responsibility to check visa and health requirements with the appropriate consulate. We strongly recommend comprehensive travel insurance to cover trip cancellations or interruptions, medical emergencies, loss of or delayed baggage, emergency evacuation and other unexpected events. Acacia Tours is not responsible for losses resulting from lack of appropriate insurance.

6. Health, Safety, & Conduct

Participants must be in suitable physical condition for their chosen tour. You agree to:

  • Follow instructions given by guides and staff

  • Refrain from illegal or unsafe behavior

  • Respect the local culture, environment, and other guests

We reserve the right to remove any person who compromises the safety or experience of others. No refunds will be given.

7. Liability & Force Majeure

7.1 Limitation of Liability

Acacia Tours provides a combination of services directly, and indirectly through third-party partners. We personally fulfill services such as guided tours, local transport, and on-the-ground assistance through our own trained team. Additionally, we act as an agent in arranging services provided by independent third-party contractors, including (but not limited to) accommodations, restaurants, and external transport providers.

While we take every reasonable care in delivering our own services and in selecting reliable partners, Acacia Tours and its employees, affiliates, and representatives shall not be held liable for any acts, omissions, errors, or negligence on the part of these third-party providers.

To the fullest extent permitted by law, Acacia Tours shall not be held liable for any loss, injury, damage, delay, or inconvenience arising from either:

  • Circumstances beyond our reasonable control (see Force Majeure below), or

  • The acts or omissions of third parties not employed or directly supervised by Acacia Tours.

Where Acacia Tours directly provides the service (e.g., a guided tour or private vehicle transport), liability for any damages shall be limited to the amount paid by the client for that specific service. Under no circumstances shall Acacia Tours be held liable for indirect or consequential damages.

7.2 Force Majeure

Acacia Tours shall not be liable for any failure or delay in performing its obligations — including but not limited to changes, cancellations, or interruptions of service — due to events beyond our reasonable control, whether foreseeable or not. These events may include (but are not limited to):

  • Acts of God (e.g., earthquakes, floods, fires)

  • Severe weather conditions

  • Epidemics, pandemics, or public health emergencies

  • Government mandates or restrictions

  • Labor strikes or disputes

  • War, terrorism, or civil unrest

  • Power failures or transportation disruptions

In such cases, we will make every reasonable effort to offer suitable alternative arrangements. However, we reserve the right to cancel, modify, or postpone services without liability and without offering compensation beyond any recoverable costs not already paid to third parties. Refunds for services not rendered due to force majeure are not guaranteed and are subject to the terms and conditions of our suppliers.

8. Punctuality & Missed Departures

Clients are responsible for arriving at the designated meeting point on time, including allowing for flight delays, customs clearance, and travel to the starting location. Tours will depart as scheduled. If a client is late or misses the start of the tour for any reason, no refunds or compensation will be provided. Clients may rejoin the tour later at their own expense, and we will assist where possible, but all costs are the client’s responsibility. We value open communication and will accommodate reasonable adjustments when informed in advance, subject to availability and operational feasibility.

9. Intellectual Property

All content on our website and promotional materials, including logos, text, images, and itineraries, is the intellectual property of Acacia Tours. Use or reproduction without prior written consent is prohibited.

10. Privacy Policy

We collect and store personal data only as necessary to process your booking and improve our services. Your information will not be sold or shared with third parties except as required to fulfill your tour. Please refer to our full Privacy Policy on our website for more details.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by Portuguese law. Any disputes will be subject to the exclusive jurisdiction of the courts in Lisbon, Portugal.

12. Amendments

We reserve the right to amend these Terms & Conditions at any time. Updated versions will be posted on our website. Continued use of our services constitutes acceptance of the latest version.
